Land is a hotcake in Lagos. Getting a land generally is a big investment and due to the fact that Lagos is the most populated city in Nigeria, many real estate investors tends to target Lagos for buying of lands and building of houses.
Getting a land in Lagos is easy when you have the money however there more on it to be considered. It’s very important generally to do a property research before buying a land for your own good. From my research, one of these mistakes is a mistake of “excision in progress” which a lot of real estate development firms and some individual land vendors use as a means to commercially dispose of lands with no adequate legal title. The concept and risks of land with excision in progress are examined in this article.
What is Land Excision in Lagos State?
Literally, according to Cambridge online dictionary, “Excision” means the act of removing something. Prior to the enactment of the Land Use Act in 1978, lands were under customary ownership by the indigenous people and communities. However, by Section 1 of the Land Use Act, all land in the territory of a State is vested in the Governor of the State and held in trust for the benefit of Nigerians.
As a means of recognising these ancestral/indigenous owners, the Lagos State Government introduced a policy of giving back some portions of land to them. Land excision is, therefore, the process by which the government releases, carves out, or partitions a portion of land to those who were previously the indigenous owners. After a land has been excised, it is gazetted and officially removed from government acquired lands.

The Federal Government of Nigeria (FGN) has advised persons interested in buying lands in Lagos State to carry out a thorough verification.
The Federal Controller of Housing in Lagos, Margaret Adejobi, made the appeal in an interview with the News Agency of Nigeria (NAN) on Sunday.
The official urged the media to embark on awareness campaign against grabbers, complaining that they sold-off gazetted FGN lands in the state.
Adejobi advised citizens to always check lands with with federal and state government agencies before purchase.
She said grabbers ignore compensations paid to their fathers, encroach on gazetted government lands and fraudulently sell the same to multiple buyers.
“Every day, I receive court summons, petitions. Even learned people fall victims to these land grabbers. Anybody who wants to buy land should do a search.
“They can go to the Surveyor General’s Office in Alausa, or our office here at the Tafawa Balewa Square and check”
The controller said.
Adejobi announced that a Presidential Implementation Committee had sold off nearly all FGN buildings in Lagos.
